Workers' Compensation Insurance
Texas & All 50 States

Workers' Compensation insurance protects your employees when they are injured or become ill as a result of their work. In Texas, WC is technically optional for private employers — but most general contractors require subcontractors to carry it, and going without it exposes your business to unlimited personal liability for employee injuries.

Medical Expenses

Covers all reasonable and necessary medical treatment for work-related injuries or illnesses — doctor visits, surgery, prescriptions, and rehabilitation.

Lost Wages (Indemnity)

Pays a portion of the employee's lost wages (typically 70% of average weekly wage) while they are unable to work due to a covered injury.

Permanent Disability

Provides compensation for permanent partial or total disability resulting from a work-related injury or illness.

Death Benefits

Pays burial expenses and ongoing benefits to dependents of an employee who dies as a result of a work-related injury or illness.

Employer's Liability

Protects the employer against lawsuits from employees who are injured on the job and choose to sue outside of the workers' comp system.

Workers' Comp in Texas — What You Need to Know

Texas is the only state where private employers are not required by law to carry WC — but non-subscribers face unlimited personal liability for employee injuries.

Most general contractors and project owners require all subcontractors to carry WC as a condition of working on their job sites.

Without WC, you cannot use common law defenses (assumption of risk, contributory negligence) if an employee sues you.

State and local government contractors in Texas are required to provide WC coverage for their employees.

Our program covers all 50 states — ideal for contractors who work across state lines.

The Risk of Going Without WC

Texas employers who choose not to carry WC (called "non-subscribers") face serious financial exposure:

  • Unlimited personal liability for employee injury claims
  • Cannot use assumption of risk or contributory negligence as defenses
  • Must report non-subscriber status to the Texas Department of Insurance
  • Risk of losing contracts that require WC certificates
  • Potential for multi-million dollar jury verdicts in injury lawsuits
